Judge’s decision on September 6 comes on eve of first day back to school in NYC

Nearly 300 people showed up to the Richmond County Supreme Courthouse on August 14 to support a Teachers for Choice lawsuit that is backed by Children’s Health Defense. The case was initiated with the support and vision of Robert F. Kennedy Jr, and is titled DiCapua v. City of New York.
We rallied with amazing speakers including Mary Holland, Sujata Gibson, John Matland, Scott LoBaido, Paul Schweit and myself.
Judge Ralph Porzio announced he will render his decision on September 6 at 3:30pm which is the day before NYC has its first day of school. We ask for everyone to pray that the judge will rule wisely and justly. Teachers for Choice is planning to be at the court that day to hold a prayer vigil (not a rally).
Our attorney Sujata Gibson argued brilliantly in court laying out precisely why two things must happen:
- The plaintiffs in this case must be given their jobs back with backpay, and;
- A class needs to be certified to allow any teacher, educator, NYC DOE employee or contractor displaced in any way for declining covid vaccination to be a part of the lawsuit.
Before the proceeding began, Judge Porzio worked diligently for over 20 minutes in the courtroom to allow as many people as possible to sit and watch the arguments. I overheard the judge telling court officers “these people have a right to be here in the courtroom.” At first I was moved to sit next to attorneys Sujata Gibson and Mary Holland, but was then directed by the court officers to move to the jury box. Judge Porzio allowed all of the petitioners who were present to sit in the jury box. He joked with us and said, “You will all be our next jury” with a smile.
Even after all of Judge Porzio’s respectable efforts over a hundred people were unable to enter the court.

It was fantastic to see a ton of support for Robert F. Kennedy Jr. among those at the rally. Every button, flyer and bumper sticker supporting Kennedy’s Presidential Campaign was taken, worn, handed out and appreciated. I had many people asking me how we could raise awareness that they need to register as a Democrat to vote for Kennedy in the primary.
I explained the 5 most important states in the primary election are New Hampshire, South Carolina, Iowa, Michigan and Nevada – the first 5 states of the Democratic Primary. A woman said to me “I’m going to South Carolina next week!” So we gave her a stack of flyers to take to S. Carolina to promote Kennedy.
We wouldn’t have any of these lawsuits in New York fighting for fired workers if it wasn’t for Robert F. Kennedy Jr. He supported US, now WE support HIM!
